Starting from a reconstruction of the discriminatory measures reinstated by the Taliban against women in Afghanistan, this article examines the judgment of the Court of Justice of 4 October 2024, in joined cases C-608/22 and C-609/22, AH and FN. It shows how the Court, drawing on the Afghan case, formulates two principles of general relevance concerning the determination of "acts of persecution" and the procedures for examining asylum applications. By demonstrating how the judgment contributes to strengthening the gender perspective in refugee law, providing national courts with a new tool for making the right decisions, the article also investigates its practical impact in light of the new European regulatory framework on asylum, which is about to come into force.
