The aim of this article is to analyse the legal instruments adopted within the framework of the EU Pact on Migration and Asylum in light of the Council of Europe Istanbul Convention on preventing and combating violence against women and domestic violence, in particular Article 60 thereof. While acknowledging certain progress in recognising the gender dimension and intersectionality, this perspective remains absent or marginal in several instruments, thus requiring systematic interpretation in accordance with the Istanbul Convention. Alongside these shortcomings, however, a growing sensitivity to gender issues has emerged in the recent case law of the Court of Justice of the EU, which in three judgments delivered in 2024 referred to both the Istanbul Convention and CEDAW as parameters for interpreting EU law. The article highlights how, through both legislative and jurisprudential developments, a gender perspective is gradually being incorporated into EU migration law.
