331The paper examines the international protection of LGBTQIA+ asylum seekers in the European Union. With regard to applications for international protection based on sexual orientation, there is a need to find a delicate balance between adopting appropriate standards of proof and preventing the procedure from being exploited, without this resulting in an unreasonable restriction of the protection of the fundamental rights of the applicant as a vulnerable person. This balance is particularly complex where the assessment of credibility relies primarily on the applicant's statements in the absence of documentary evidence, requiring national authorities to adopt evaluation criteria that respect human dignity and are proportionate to the objectives of international protection. The analysis therefore focuses on the interaction between legislative developments and judicial interpretation in the broader European context and the methods used to assess the credibility of applicants in light of the elements underlying their claims for international protection. This analysis is part of the overall framework of protections currently recognised for LGBTQIA+ persons seeking international protection, highlighting convergences, tensions and possible developments, particularly in view of the forthcoming entry into force of the instruments of the new Pact on Migration and Asylum.
