The essay analyses and criticizes the view according to which the regional law on concurrent matter which – without infringing any State provision, regulates aspects considered to be of a primary importance to a certain subject, in the absence of a similar provision by the national legislator – invades the State’s reserve of determining the fundamental principles, and it is, therefore, in conflict with the Constitution. The essay then addresses the related issue of the constitutionality of the reproduction of a fundamental principle of the matter by the regional law.
