1380The essay traces the evolution of legislative subsidiarity as a dynamic criterion for allocating competences, one that challenges the rigidity of the traditional subject-matter-based distribution of powers. Against this back drop, the Author explains how subsidiarity acts as a new title of competence grounded in unifying national needs and characterised by a goal-oriented, functional structure. The analysis then explores the atypical patterns of interaction between State and regional legislation and the adequacy test. Particular emphasis is placed on by procedural safeguards, which operate as essential guarantees for regional autonomy; on the coordination between legislative subsidiarity and regulatory powers; and on the possibility of mixed organisational arrangements capable of ensuring the unitary exercise of public functions. The concluding assessment shows how subsidiarity has rendered the system more flexible, reinstating the central role of the national interest and strengthening loyal cooperation as the principal mechanism for the dynamic adjustment of relations between State and Regions.
