The commentary outlines the State regulation of constraints prior to expropriation in municipal urban planning, recalls the Constitutional Court’s case law on the protection of private property in urban planning and expropriation, and outlines the limits on the legislative autonomy of the Regions and the Autonomous Provinces of Trento and Bolzano in this regard. The commentary then illustrates the specific case, decided by the Constitutional Court in accordance with its precedents. Finally, the commentary outlines the arguments not used by the Province of Bolzano, but which it could have advanced in defence of the provincial law at issue in the case to obtain a favourable ruling.
