The case note examines Constitutional Court judgment 48/2025, which dismissed the government’s challenges to a law enacted by the Region of Apulia aimed at supporting the implementation of a national programme for vaccination against the human Papillomavirus (HPV). The Court characterises the regional measure as a form of «gentle push» (nudge), devoid of any coercive character and not infringing upon state competence, since it neither introduces mandatory vaccination nor makes school enrolment conditional upon prior vaccination. The ruling is of significant systemic importance, as it confirms a model of cooperative regionalism in which Regions may contribute, within the limits of their respective competences, to the implementation of state public policies, while giving effect to the principles of cooperation, subsidiarity, and differentiation.
