157The essay begins with the hypothesis that the concept of "material constitution" indicates the concrete historical totality of the causes underlying formal constitutions. Indeed, the fundamental questions of constitutional theory are the following: why are formal constitutions written? Why do they come into force and remain effective? Why do the interpretative and applicative practices that stem from the formal constitution and shape the "living constitution" develop in certain directions rather than others? All of these problems cannot be satisfactorily addressed without considering the underlying material conditions that make both the formal and the living constitution possible. One of the fundamental theses, therefore, is that law has a dual aspect, one "formal" and the other "material". It is thus necessary to clarify what is meant here by "material" and to which "matter" precisely refers. In this regard, it is hypothesized that, despite what may initially appear to be a terminological and conceptual opposition, the adjective "material" does not have a meaning different from what Hegel intended by the adjective "spiritual" (but in the sense of "objective spirit"). Indeed, the investigation into the material constitution concerns, upon closer examination, the 'Wirklichkeit' of statehood and corresponds to Hegel’s "science of the State", which "should be nothing other than the attempt to conceptually understand the State and present it as something inherently rational".
