153The pursuit of happiness has been a central theme throughout history, particularly during periods of significant uncertainty. Key events such as the American Revolution, the 2007-2008 financial crisis, and the COVID-19 pandemic have prompted individuals to reflect on the nature of happiness and how to achieve it. Historically, happiness has been viewed not merely as a gift but as something that can be sought and attained through personal actions. This shift in perspective became particularly pronounced during the Enlightenment, when happiness was increasingly recognized as a fundamental right linked to individual freedom and the ability to strive for a better future. The essence of happiness often lies in the anticipation of fulfilling one’s desires, highlighting a connection between happiness and future expectations. This relationship has been a recurring theme in history, emphasizing the role of laws and institutions in supporting the quest for happiness. Notably, the concept of happiness has been enshrined in rights and legal frameworks. In this article, I pay particular attention to the programmatic nature of laws and language of rights considered as a promise of happiness since the Enlightenment. This underscores why happiness is not only a personal goal but also a societal obligation that should be protected and promoted.
