The paper analyzes the recent Court of Cassation ruling in the ENI case. After placing the dispute within the broader context of national and European climate justice developments, it reconstructs the parties’ positions and examines the issues addressed by the Court. It highlights how its clarifications may significantly influence the evolution of climate litigation in Italy, stressing alignment with the ECtHR in KlimaSeniorinnene and divergences from the Civil Court of Rome in the Giudizio Universale case. The paper concludes with critical reflections on Italy’s climate performance and prospects for a possible new paradigm of climate justice.
