Recent legal anthropology trends, as expressed by jurists, consider the category of human subject as a legal subject (Cotta) to be outdated. The philosophy of mythology, revelation (Schelling), and religion (Hegel), centred around an absolute, suggests that the truly political subject is the free subject of the right to freedom: the metaphysical truth of the subject of law is the truth of freedom (Fabro), both spiritual and civil, which forms the basis of a fundamental right: the right to metaphysics in general (Jaspers) and, specifically, "the right to the metaphysics of law" – not only concrete (Cacciari) but "current" and relevant (Capograssi, Bruaire, Dijon, Henrich, Schulz). Beyond the traditional dichotomy is/ought, the subject’s capacity and accountability are reconsidered in the context of a being-able-to-be that makes law conceivable as a specific power, insofar as it codifies a political system of freedom: the theoretical core of a positive philosophy of legal experience.
