311The aim of this work is to analyze the transition process that starts from the duty to live and is destined to culminate in the right to life. After the reconstruction of the general duty to live pertaining to the generality of human beings, its frictions will be shown with the axiological personalistic system of all modern constitutions. Secondly, the peculiar case of people suffering unbearable illnesses will be taken into consideration. Finally, a legislative ("de jure condendo") proposal will be developed in order to make sure that the right to life – and therefore, as will be explained, inevitably also the right to die – can be guaranteed.
