The paper aims to offer a different view on the hierarchy of remedies for lack of conformity, from the perspective of environmental sustainability. Although European consumer law increasingly embraces the principles of sustainable development and circular economy, the current remedial framework still allows consumers to freely choose between repair and replacement. This freedom of choice creates inconsistency between the proclaimed goals of sustainable consumption and the actual operation of the remedies system. From the legal framework an unstated norm. Whenever both repair and replacement can adequately satisfy the consumer’s interest, the consumer should be required to prefer the more sustainable remedy – that is, repair.
