After a critical analysis of the main positions taken on the renunciation of immovable and the recent ruling by the Joint Divisions of the Court of Cassation, this essay aims to offer an alternative solution to the problem, one that takes due account of the specificities and interests involved in each case of renunciation, through a reinterpretation of the traditional concepts of emulative acts and abuse of rights.
