This article examines the application of German antitrust law to the banking sector. It analyzes key proceedings initiated by the German Federal Cartel Office ("Bundeskartellamt"), including interventions regarding ATM withdrawal fees, contractual limits on online payment service providers, and vertical restraints in digital payment systems. Particular focus is placed on the ongoing investigation into PayPal’s efforts to prevent traders from differentiating prices based on payment methods chosen by the consumer. The case demonstrates how traditional antitrust concepts must evolve to address digital markets and highlights the tension between payment services regulation and competition policy.
