In this contribution, the author examines the role of the Constitution in protecting the rights of incarcerated individuals, with particular attention to the principle of rehabilitation as a purpose of punishment. Through the analysis of constitutional and supranational jurisprudence, and in light of current critical issues in the Italian prison system, the paper highlights the urgent need for reform centered on human dignity, proportionality of penalties, and the full effectiveness of fundamental rights throughout the execution of the sentence.
