Since its establishment with Dpr 448/1988, the Italian juvenile justice system has embraced an innovative educational and restorative approach, moving beyond punitive adult criminal law. Article 28 allows the suspension of proceedings with probation, integrating restorative justice programs involving minors, families, and communities. This model focuses on the minor’s gradual responsibility through personalized, dialogical paths fostering repair and social reintegration. Early restorative experiments began in the 1990s and evolved into a national network supported by social services and judiciary, promoting effective practices. Recent studies highlight restorative justice’s transformative power, enhancing accountability and reconciliation among offenders, victims, and communities. This evolution culminated in Legislative Decree 150/2022, embedding restorative justice across juvenile proceedings and affirming Italy’s role as a laboratory of humane, relational justice.
