This article aims to verify whether the organic discipline of restorative justice introduced by d.lgs. n. 150/2022 guarantees, in addition to the responsibility of the person indicated as the perpetrator of the offense and the involvement of the community, also the recognition and active and voluntary participation of the victim. In particular, it is intended to verify whether the principle of fair consideration of protagonists in restorative programmes has been respected. After a historical introduction, the analysis will examine the access to, development of, and outcomes of restorative programmes. Questions regarding the recognition of facts, surrogate victims, and the multiple meanings of the concept of reparation will be examined in depth. The final paragraph reiterates the need to reconsider the role of the mediator.
