91The article critically analyses the widespread presumption of economic relevance attributed to public-private collaborations in the cultural sector, showing that such a presumption finds no necessary foundation either in European Union law or in comparative practices. Building on the distinction between services of general economic interest and non-economic services of general interest, the paper examines special public-private partnerships as developed in the practice of Italian municipalities, for the management of cultural heritage as forms of shared exercise of the public cultural function, grounded in co-design and in the cultural responsibility assumed by the private partner. Through a systematic analysis of Italian legal scholarship, EU law and selected European experiences in France, Germany, the United Kingdom and Spain, the article demonstrates that the presence of revenue-generating activities does not, in itself, determine the economic nature of the relationship, where such activities are functionally subordinated to the cultural mission. From this perspective, cultural partnerships are more coherently classified within the category of non-market cultural services and public-private cultural partnerships, thereby opening spaces of contractual and project autonomy that are currently constrained by restrictive interpretations of competition law.
