The paper suggests a reflection on public administration in the «climate neutrality» state, starting from the approach referred to it by the climate litigation doctrine and then transferring the inquiry to existing law, in an attempt to find out some overall indications. A focal point and key is a 1929 essay in which H. Kelsen discusses the “State of the Future,µ predicting that it will advance “direct administrationµ (administrative state) at the expense of “indirect administrationµ (judicial state). The article suggests, however, that the “climate neutralityµ state has been organized by existing legislation to be a judicial state and that the image of an administration directly pursuing climate protection is, even now, definitely to be excluded
