The article considers the relevance of a “gender and lawµ approach for recent comparative constitutional law scholarship. After providing a methodological clarification of the meaning of a gender/sex perspective for legal inquiries, it illustrates various trends of feminist jurisprudence and their views on subjectivity, equality and difference. It then focuses on conflict around some of the most controversial issues, including gender violence, the relationship of body and market, multiculturalism, abortion and political representation.
