This essay analyses a recent decree delivered by the Italian Supreme Court of Cassation, on a legal dispute between two separated parents over the Catholic religious education of their daughter. The Court found that, in order to establish the best interests of the child, the lower court should have heard her and considered all the factual elements of the case. Continuity in education and the stability of the social environment are key aspects in defining the best interests of the child involved. Following the Supreme Court considerations, it will be suggested that a special attention should have been given to the child’s autonomy in matters of freedom of religion, to be balanced with the religious and educational rights of her parents. The essay will also discuss the Supreme Court statement over the role of religious education in the contemporary, multicultural society, which rises contentious questions on the need to rethink and reassess the frame of reference and organization of religious education in Italian public schools.
