857The essay aims at giving an account of the development, at times even controversial, that the English legal system has undergone in the elaboration of the category of laws and principles of a constitutional nature. In particular, it is recognized how, differently by continental legal systems, this hierarchy is based on the resistance of such laws to repeal/amendment by parliamentary power, unless done explicitly or even by necessary implication. In conclusion, the article considers whether this model effectively safeguards fundamental rights as envisioned by the common law tradition and other constitutional pieces of legislation.
