This paper examines the scope of application of declaratory action in administrative trial. It begins by clarifying that this remedy is admissible in administrative proceedings, as there is no incompatibility with the inexhaustibility of administrative power. The analysis then focuses on two prerequisites that condition the admissibility of declaratory action in administrative trial: the limits to the decision-making powers of the administrative judge and the interest in bringing proceedings. Both reveal a narrow scope of application for the remedy, but within which significant cases arise, making the protection of declaratory actions essential as a residual remedy that completes the system of actions available in administrative trial.
