The author analyses the recent case law of the Court of Cassazione on the subject of fair remuneration, questioning the impact that it may have on the Italian wage setting system; this in order to assess whether and to what extent the right enshrined by Article 36 (1) of the Constitution is actually strengthened. The various indicators of adequacy to which the Supreme Court appeals to base its judgement on the constitutional consistency of the sectoral collective agreement, are then analysed. The doubts as to their effectiveness in containing the involutional dynamics at work in the collective bargaining system, suggest a critical confrontation with the jurisprudential approaches concerning the selection of the sector collective agreement taken as 'parameter', to be used to concretely determine the constitutionally adequate amount of the worker's remuneration.
