Il presente contributo analizza la disciplina della fase esecutiva del concordato preventivo osservando il rapporto tra il regime di sorveglianza che viene attribuito dai Tribunali al Commissario Giudiziale e al debitore con la sentenza di omologazione e le novità introdotte con il decreto correttivo-ter nel Codice della Crisi e dell'Insolvenza rispetto alla modifica del piano successiva all'omologazione. This paper analyzes the regulation of the enforcement phase of the prebankruptcy composition with creditors by observing the relationship between the supervisory regime that is attributed by the Courts to the Judicial Commissioner and the debtor with the homologation of the proposal and the novelties introduced with the corrective-ter decree in the Italian Code of Crisis and Insolvency with respect to the modification of the plan following the homologation.
