215This article analyzes constitutional customs and conventions from a theoretical standpoint, complemented by empirical evidence derived from comparative constitutional law. Its objective is to elucidate the pragmatic constitutional function of these conventions in countries with civil and common law traditions. Constitutional customs and conventions are regarded as "extra-textual sources" of constitutional law, distinct from the written text. They are frequently associated with unwritten constitutional rules that extend beyond the canonical text of the Constitution. Constitutional customs assume a substantial role in addressing legal gaps and clarifying ambiguities within written constitutional provisions. Conversely, constitutional conventions represent non-legal principles that guide the conduct of pivotal constitutional officials and institutions.
