365This paper examines the role of the Belgian Constitutional Court in managing the Covid-19 pandemic crisis, analyzing a corpus of over thirty decisions through which the Constitutional Court exercised penetrating judicial review of emergency legislation. The analysis focuses on three fundamental aspects: the impact on the federal structure, the effects on parliamentary dynamics, and the repercussions on the system of fundamental rights protection. Particular attention devotes to the methodological approach developed by the Court, characterized by a balanced reconciliation between judicial review and respect for legislative discretion. The jurisprudential elaboration has contributed to defining a comprehensive interpretative framework for managing emergency situations, based on the principles of proportionality, temporariness, and necessity, which may serve as a reference paradigm for other constitutional systems.
