In the light of the doctrinal debate on the relations between differentiation (Article 116.3 Const.) and specialty (Article 116.1 Const.), the essay analyzes the exclusion of special Regions from the possibility of availing themselves of differentiation under Article 116.3 Const., established by Sent. no. 192 of 2024 with the declaration of unconstitutionality of Article 11 of l. 86/2024. The essay assesses the systemic implications of the Court’s decision within the general framework of Italian regionalism, highlighting the relations between ordinary and special regionalism.
