614Has the Court of Justice evolved over time into a kind of Constitutional Court of the European Union? This article seeks to address that question by examining the Court of Justice’s case law in the field of so-called «constitutional matter», with particular attention to the principle of non-discrimination. To this end, it analyses a selection of the Court’s most significant rulings – both before and after the entry into force of the Treaty of Lisbon – considering their structural and substantive dimensions. While this analysis reveals certain similarities with the role of national Constitutional Courts, the substantial differences that persist suggest that, at least for now, the Court of Justice cannot yet be regarded as a true Constitutional Court. Nonetheless, recent jurisprudential trends point to a clear and growing aspiration in that direction.
