693This essay analyzes the quantitative decline in incidental constitutional review proceedings, examining statistical data on referral orders and subsequent decisions (since 1990), seeking to identify the causes of the decline in litigation and investigating the impact of the access phase on the Constitutional Court’s policies and its working methods. The conclusion is that this decline has not actually penalized constitutional review. Indeed, the number of cases upheld has increased, and the Court has drawn inspiration from the new context to enrich its judgment (amending articles 5, 6, and 17 of the Supplementary Rules) and to correct or develop certain guidelines in order to strengthen centralized review and, with it, the principles of constitutionality and legal certainty. It has done so without forcing procedural rules and by giving balanced space to its dual vocation, both jurisdictional and political.
