The paper, after a short description of the "Cannavacciuolo" pilot judgment, makes a comparison with other previous decisions against Italy in the field of environmental pollution detecting frequent references by the Court, with autonomy of evaluation, to the rulings of the Court of Justice of the European Union; this comparison, moreover, shows a tendency of the Strasbourg Court to pronounce itself the general measures for the execution of the decision without waiting the Committee’s evaluation either by indicating them in the part of the reasoning relating to art. 46 ("Cordella" judgment) or by recourse to the pilot judgment procedure ("Cannavacciuolo" judgment). Finally, is positively stressed the "Cannavacciuolo" judgment for not excluding the possibility of a subsequent sentence to the payment of just satisfaction in favour of the applicants in the event of an unsatisfactory response by the state authorities.
