This paper critically examines Italian Decree No. 48 of 11 April 2025, as converted into Law No. 80 of 9 June 2025. It focuses specifically on Articles 9, 15, and 27, assessing their compatibility with international legal standards protecting the rights of children, foreigners, and female prisoners. The analysis argues that these provisions are in tension with international human rights obligations and explores potential avenues for judicial review within the Italian legal system. In this context, the paper expresses hope that the Italian Constitutional Court will be called upon to assess the decree’s compatibility with international norms, as required under Articles 10 and 117 of the Italian Constitution.
