466This paper draws attention to the decision issued by the ECtHR in "Lenis v. Greece" case within the framework of the evolving case-law related to homophobic hate speech. The main point of interest is the application of the prohibition of abuse of the right enshrined in Article 17 ECHR by means of the so-called 'guillotine', thus removing the applicant’s complaint from the protection of Article 10 ECHR. For its inherent trenchant logic, this decision pattern is long exposed to conflicting views, particularly as concerns the omission of the proportionality test. Albeit admitting that more consistency is required, there are reasons for believing that application on an exceptional basis of the 'guillotine', here applied for the first time to sanction homophobic hatred, may provide a useful contribution to advance LGBTI people rights. Indeed, the focus shifts from the curtailing of freedom of expression to the pressing social need to ensure effective respect for the rights of others, namely those belonging to the members of social groups particularly exposed to the severe and long-lasting harmful effect of hate speech in its gravest forms, including direct incitement to violence, thereby reaffirming equal respect for human dignity in accordance with the core values of the European Convention of Human Rights.
