The article analyzes Constitutional Court ruling 206/2024, which declared the unconstitutionality of Article 1, paragraphs 1 and 2, of Calabria Regional Law no. 16 of April 20, 2023, concerning «Authorization for the operation of the chauffeur-driven rental service (NCC)», for violation of Article 117, paragraph 2, letter e), of the Constitution. It focuses in particular on the challenge regarding the principle of vertical subsidiarity (Article 118 of the Constitution). Based on the annotated ruling, the author critically addresses the issue of constitutional review of the principle of subsidiarity, attempting to offer some solutions to the problem of its difficult objectification.
