82This article explores the growing tension between law and digital technologies, focusing on the emergence of a distinct form of technological normativity. Digital technologies, particularly algorithmic systems and artificial intelligence, increasingly operate as autonomous techniques of governance and decision-making, competing with legal normativity rather than merely supporting it. Unlike law, which relies on language, justification, interpretation, and the dialectic between writing and orality, technological normativity is inherently performative, opaque, and deterministic, relying on numbers, calculations, and automatic execution. The article concludes by warning against the erosion of the legal rationality that underpins democratic legitimacy and calling for renewed forms of constitutional and legal thought capable of addressing the challenges posed by digital normativity.
