105The essay focuses on the use of artificial intelligence by public administrations and is grounded in an approach that distinguishes between different types of AI and the various ways in which it can be employed. Public administrations must comply with certain public law values in their actions, aimed at ensuring the protection of citizens and institutional accountability. These values are reflected in several fundamental guarantees concerning transparency, the duty to state reasons for administrative decisions, equality and non-discrimination, and the possibility to challenge decisions before a court. AI, however, risks undermining these values, as it is often opaque, prone to producing incorrect or discriminatory outcomes, and generally incomprehensible to non-experts. The article examines the rules established by the AI Act for the use of AI in the public sphere and explores the relationship between these European rules and the traditional safeguards of national administrative laws. It also reflects on the possible role that national legislators may play in regulating algorithmic administration.
