The author analyzes the recent law no. 76/2025 on workers participation, believing that it makes a modest contribution to the matter, as it lacks mandatory provisions. After a short examination of existing European and national legislation, he concludes that businesses can benefit from participation and believes that the provisions of article 46 of the Italian Constitution (on worker collaboration in the management of companies) do not strictly constitute a constraint on entrepreneurial freedom, but rather shape individual ownership, making large-scale production organizations a sort of "common good".
