20The essay analyzes the figure of the smart contract based on Blockchain technology, examining it from the perspective of its inexorable self-executing mechanism. It challenges the thesis that such a mechanism allows smart contracts to escape the control of the legal system, instead reaffirming the latter’s full authority over the economic operation implemented by the smart contract. It is emphasized, however, that legal protection is destined to operate essentially outside the Blockchain enviroment, through ordinary remedies such as restitution and compensation. The essay explores the practical issues raised by this contractual model, particularly: the "de facto" obstruction of systemic mechanism governing invalidity and regulatory integration; the practical sterilization of the legal significance of supervening events; and the disruption of the overall framework of judicial and extra-judicial remedies. Taking cues from discussions on potential technical solutions to address this issue, the essay underscores the broader necessity – relevant to the entire field of emerging technologies – for jurists to engage in close dialogue with experts in computer science and other techno-scientific fields. Such interdisciplinary collaboration is essential to overcome the persistent divide between the «two cultures» – scientific and humanistic – so that they may fertilize one another and converge in a unified vision of reality.
