Data protection law has emerged and evolved in close connection with technological developments, which have progressively raised new needs for legal safeguards. In light of the recent rise of artificial intelligence, the paper aims at assessing the adequacy of current data protection regulation in fostering the development of AI while ensuring a proper balance among the competing interests at stake. The analysis will focus on key data processing principles, such as the principle of transparency (Article 5(1)(a) GDPR), the right to explanation derived from Article 22 GDPR, the principle of data minimization (Article 5(1)(c) GDPR), and the purpose limitation principle (Article 5(1)(b) GDPR).
