The study examines, in light of recent jurisprudential and regulatory developments, the liability profiles of real estate brokers with respect to disclosure obligations concerning the energy performance of buildings. Starting from the progressive recognition of the professional nature of brokerage activity, the analysis focuses on the development of a liability model grounded in the integration between the Civil Code provisions (Art. 1759) and supranational environmental and energy regulations, with particular reference to Directive (EU) 2024/1275. The discussion highlights the role of case law, which – through a systematic interpretation of the relevant provisions – assigns specific weight to the broker’s duties of fairness, diligence, and transparency, including those related to energy certification. A complex professional profile thus emerges, required to fulfil articulated informational obligations within a multi-level regulatory framework marked by the affirmation of the environmental function of property and by the progressive reconfiguration of ownership rights in light of their ecological functionalization, according to a systemic rationale inspired by the principle of sustainability.
